General terms & Conditions of Sale

The purchase of any products offered the www.ethnicblue.com website is subject to the present General Terms & Conditions of Sale. These are established between the company S.A.R.L. LJ LOGISTIQUE, registered in Versailles under N°513 119 545 (VAT N° FR75513119545) having its registered offices at 3 Parc de Diane 78350 Jouy-en-Josas, hereafter mentionned as “ETHNIC BLUE”, and individual customers willing to place orders on the www.ethnicblue.com website, hereafter mentionned as “the client”.
Only individual customers or coporations purchasing goods other than for resale may purchase products on www.ethnicblue.com . Any resale or distribution of ETHNIC BLUE products purchased on the www.ethnicblue.com website is stricltly prohibited.
Any order confirmation on www.ethnicblue.com implies the acceptance of the current General Terms & Conditions of Sale.

Terms of ordering

The offer of products and prices is accurate, though subject to availability, as long as they are displayed on the website.
While every effort is taken to try to ensure that the colouring and style of the ETHNIC BLUE products in the photographs displayed on the website are representative of the original products, variations may occur due to the technical restrictions of colour reproduction on your computer equipment. The client should therefore check the description of each product.
A fixed charge for shipment will be displayed on the summary page before confirmation of the order. This summary page will display :
- the invoice address
- the delivery address
- a summary of the order
- the total amount
- shipping costs
Products and prices are valid as seen on the www.ethnicblue.com website, subject to availability. If the product is unavailable after ordering, the client will be informed by email as soon as possible.
At the end of the ordering procedure, the client is invited to confirm his order. On confirmation, the order is transmitted to the Logistic Service for treatment. The client will receive a first automatic email confirming the receipt of his order. The contract is established upon confirmation of the order.

Prices

Prices are displayed in EUR (euros) and include the current French VAT. Any VAT rate change can be immediatly applied on our prices. However, prices may not be changed after an order confirmation.

Payment

The client can pay his order on-line with a credit card, American Express, by sending a cheque or even by cash on delivery (COD).
For a payment by credit card, the client shall give indication of the number of his card and, according to the kind of card, the expiry date and the security code on the back of the card.
Please note that for a credit card payment, the client is transfered to the Société Générale bank server, hereafter called « the bank ».
The bank server is secured by SSL encryption (Secure Socket Layer) in order to protect as efficiently as possible all data linked to the payment. This data never transits on the ETHNIC BLUE system.
According to the French law « Loi du 13 mars 2000 sur la signature électronique », by giving his card number on-line and confirming his order, the client is held responsible for the order and ows the total amount of the order. This confirmation means the acceptance of the whole Terms & Conditions of Sale, and is the signature to the contract.
Delivery
Every effort is made by ETHNIC BLUE to deliver orders within 3 to 5 (three to five) working days upon payment.
Shiping costs will amount to 5.90€ for deliveries in continental France. For other deliveries, the shipping costs will be displayed on the summary page of the order.

Receipt

On delivery, the client should check his order. Any discrepancy or problem should be reported within a maximum of 15 (fifteen) calendar days from the date of delivery, by mail or e-mail.
Except for legitimate reasons, no claim reported later than 15 (fifteen) calendar days after delivery will be accepted and ETHNIC BLUE will not be liable for it.
ETHNIC BLUE reserves the right to ask the client to ship back the non compliant or defective products.
ETHNIC BLUE reserves the right to cancel any order placed by a costumer with whom it has a dispute concerning a prior order.
Right of withdrawal
The client can return the products that he ordered within 30 (thirty) working days after delivery, without any reason.
The product shall be returned in its original condition to the following address : EthnicBlue.com – COPA TEXTILE, 57 rue Notre Dame de Nazareth 75003 PARIS, with the Return Note.
The client shall follow the instructions on the Return Note. Only articles which have not been worn, in their original condition are eligible to refund or exchange.
If the above conditions apply, ETHNIC BLUE will refund the total amount of the order, including shipping costs, within 7 (seven) calendar days upon receipt of the returned products.

Exchanges & Refunds

The client can ask for an exchange or a refund of his order within 30 (thirty) working days after delivery.
The client shall follow the instructions on the Return Note. Only articles which have not been worn, in their original condition are eligible to refund or exchange.
For an exchange, if the new order is superior in value to the original total amount, the client shall send the payment of the remaining amount with the articles returned. If the new order is inferior in value to the original total amount, the customer will receive a payment of the difference with the means of payment he used.
For refunds, if the above conditions apply, ETHNIC BLUE will refund the articles, within 30 (thirty) calendar days upon receipt of the returned products.

Guarantee

All ETHNIC BLUE products are covered by the French law regarding guarantee as long as the use is normal and care instructions are respected.
Extracts of the French law regarding Guarantee: 
Article L211-4 du code de la consommation 
Le vendeur est tenu de livrer un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance.
Il répond également des défauts de conformité résultant de l'emballage, des instructions de montage ou de l'installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.
Article L211-5 du code de la consommation
Pour être conforme au contrat, le bien doit :
1º Etre propre à l'usage habituellement attendu d'un bien semblable et, le cas échéant :
- correspondre à la description donnée par le vendeur et posséder les qualités que celui-ci a présentées au client sous forme d'échantillon ou de modèle;
- présenter les qualités qu'un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage;
2º Ou présenter les caractéristiques définies d'un commun accord par les parties ou être propre à tout usage spécial recherché par le client, porté à la connaissance du vendeur et que ce dernier a accepté.
Article L211-12 du Code de la consommation
L'action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.
Article 1641 du code civil
Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage, que le client ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus.
Article 1648 alinéa 1 du code civil
L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice.

Personal data

All personal data is used by ETHNIC BLUE for customer relations between ETHNIC BLUE and the client. ETHNIC BLUE will in any case give this information to a third party.

ETHNIC BLUE reserves the right to collect data through the use of cookies on the website.
Liability
ETHNIC BLUE shall not be liable to the customer for any default of this contract due to a case of force majeure, such as strikes of the Post offices or other transporters, communication problems, flood or fire.
ETHNIC BLUE shall not be liable for problems or damages caused to the client linked to the use of the Internet, such as viruses, third party intrusions, or thechnical problems with the service or the provider.
The present General terms and Conditions of Sale apply to the complete offer displayed on the website and as long as it is on-line.
Governing law and jurisdiction
These Terms and Conditions of Use shall be governed by and construed in accordance with French law. The language of these Terms and Conditions of Use is French. In the event of a dispute, the French courts shall have exclusive jurisdiction and the client hereby agrees to submit to the exclusive jurisdiction of such court.
